1. GENERAL INFORMATION

These Terms of Service govern the use of the MONUMENTA website and the purchase of products offered on monumenta.art.

By placing an order on our website, you acknowledge having read and accepted these Terms of Service without reservation.

2. PRODUCTS

2.1 Description
All MONUMENTA products are monumental resin artworks, exclusively made to order in our partner workshops located in the European Union.

2.2 Artisanal Nature
Each sculpture is a unique handcrafted creation painted by hand by our European artisans. Products therefore present natural variations in paint finishes (drips, splashes, splash effects), color nuances, surface details, and artistic effects. These variations are inherent to the artisanal creation process and do not constitute a defect.

2.3 Non-Contractual Photos
Photographs are provided for illustrative purposes only. Some images include 3D renders and digitally generated visuals. Each sculpture is unique and handcrafted. The Customer acknowledges and accepts that the sculpture received will be similar but not identical to the photographs presented, each piece being unique. This artisanal uniqueness is an integral part of the value and exclusive character of each MONUMENTA creation.

2.4 Custom-Made Products
Each piece is custom-made according to your specifications and cannot be returned, exchanged, or refunded under normal circumstances, in accordance with Article L221-28 of the French Consumer Code.

3. ORDERS

3.1 Order Process
Orders are placed directly on our website. Each order must include:
- Complete delivery address (or freight forwarder address for islands/overseas territories)
- Valid contact information
- Payment information

3.2 Order Confirmation
Upon validation of your order, you will receive a confirmation email detailing:
- Order reference
- Product details
- Total amount including all taxes
- Estimated delivery time

3.3 Payment
Full payment (100%) is required upon order validation. This requirement is justified by the custom-made nature of each creation and immediate production launch.

Accepted payment methods: credit card (Visa, Mastercard, American Express), bank transfer (upon request for large orders).

IMPORTANT: Payment immediately initiates the production of your custom piece. In accordance with Article L221-28 of the French Consumer Code regarding goods made to consumer specifications, no refund or right of withdrawal applies, except in case of product damaged during transport or manifest error in the order.

3.4 Order Modification or Cancellation
Due to immediate made-to-order manufacturing, no modification or cancellation is possible after payment validation.

4. PRICING

All prices are indicated in Euros (€) including all taxes (VAT).

Prices displayed include FREE DELIVERY for all destinations covered by MONUMENTA:
- Continental Europe (27 EU countries) excluding Switzerland and Norway: direct delivery to your address
- European islands (Corsica, Balearics, Cyclades, Crete, Sardinia, Sicily, etc.): free delivery to continental freight forwarder/port
- Overseas French Territories excluding Pacific zone (Guadeloupe, Martinique, Saint-Martin, etc.): free delivery to continental freight forwarder

IMPORTANT: For European islands and overseas territories, final maritime transport from the continental freight forwarder/port to the final destination is at the Customer's expense.

We reserve the right to modify our prices at any time, but products will be invoiced at the rates in effect at the time of order validation.

5. MANUFACTURING AND DELIVERY

5.1 Made-to-Order Manufacturing
Each sculpture is manufactured exclusively to order in our partner workshops based in the European Union. No stock is maintained. This method guarantees rigorous quality control and authenticity of each piece.

5.2 Production and Delivery Times
Average time between order validation and final delivery: 15 days to 3 weeks, broken down as follows:
- Manufacturing and quality control: 7 to 14 business days
- Packaging and preparation: 2 to 3 business days
- Transport and delivery: 3 to 7 business days depending on destination

These times are indicative and may vary depending on the period, order volume, and carrier availability.

Each sculpture is protected by professional reinforced wooden crate packaging, specially designed to ensure maximum protection during transport.

5.3 Delivery Zones
MONUMENTA offers FREE DELIVERY in the following zones:

Continental Europe (27 EU countries), except Switzerland and Norway : delivery to your address (home or business)

European Islands: Free delivery to continental freight forwarder/port of your choice. You must provide complete freight forwarder address when ordering. Final maritime transport to the island is at your expense.

Overseas French Territories (excluding Pacific): Free delivery to continental freight forwarder (generally Le Havre). You must provide complete freight forwarder address when ordering. Final maritime transport to overseas territories is at your expense.

5.4 Tracking
A tracking number will be provided by email once your order is shipped. All shipments are tracked to their final delivery point (your address or freight forwarder).

5.5 Reception and Inspection

For Continental Europe (direct delivery):
Our sculptures are professionally packaged with multiple layers of protection. Always accept the package, even if the outer carton shows signs of wear or tears - the sculpture inside is generally intact.

If the carton is visibly damaged, take photos and note a simple reservation on the delivery slip: "standard reservation, damaged carton."

Unpack carefully following our instructions (see section 7.3). If damage is found on the sculpture itself, contact us with photos within 48 hours at contact@monumenta.art

After this 48-hour period or in the absence of notification, the sculpture is considered compliant and definitively accepted. Damage caused by improper unpacking (box cutter, sharp objects) cannot be covered.

For European Islands and Overseas Territories (freight forwarder delivery):
Your freight forwarder must inspect the package upon receipt at the continental port/warehouse following the same procedure. Any reservations must be noted immediately and communicated to us within 48 hours. Once the sculpture has left the freight forwarder for its final destination, MONUMENTA can no longer be held responsible for damage during maritime transport.

6. RIGHT OF WITHDRAWAL

6.1 Exclusion of Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to consumer specifications or clearly personalized.

MONUMENTA sculptures being manufactured exclusively to order according to a personalized artisanal process and manufacturing being launched immediately after payment, no right of withdrawal can be exercised. The Customer cannot therefore return, exchange, or request a refund of a sculpture for simple change of mind.

6.2 Exceptions

A return and refund are possible only in the following cases:

- Product damaged during transport (reported within 48 hours with photos to contact@monumenta.com)
- Manifest error in the order received (wrong product, wrong color ordered)

In case of transport damage:

Upon validation of the damage claim, MONUMENTA will organize and cover all costs related to the return of the damaged sculpture to our workshops and its repair or replacement. No additional fees will be charged to the Customer.

Estimated total processing time: 6 to 8 weeks (including return shipping, repair/replacement, and re-delivery).

In case of order error:

MONUMENTA will proceed with immediate replacement or full refund, after examination of supporting documents provided by the Customer.

7. WARRANTY AND LIABILITY

7.1 Product Quality
We guarantee the quality of materials and manufacturing of each piece according to European standards. Each sculpture is made from high-quality resin and protected with professional-grade high-protection varnish that durably preserves colors.

7.2 Legal Warranty of Conformity
In accordance with Articles L217-4 and following of the French Consumer Code, the Seller is required to deliver goods conforming to the contract and is liable for defects of conformity existing at the time of delivery.

7.3 Unpacking Instructions - VERY IMPORTANT
WARNING: Our artworks are made of resin and require delicate handling.

When unpacking:
- NEVER USE box cutters, knives, or sharp objects near the resin surface
- Open the package carefully, away from the artwork
- Use your hands or round-tip scissors to remove protective films
- Resin marks and scratches easily - any contact with a sharp object will leave permanent marks
- Any damage due to improper unpacking cannot be covered

7.4 CARE INSTRUCTIONS AND CONDITIONS OF USE

PRODUCT CHARACTERISTICS:
Our sculptures are designed for both indoor and outdoor use. Each sculpture is crafted from high-quality resin and protected with professional-grade high-protection varnish that durably preserves colors. However, like any artwork exposed to natural elements, progressive structural degradation is normal and expected over time.

OPTIMAL CONDITIONS OF USE:
To ensure the best durability and preserve the structural integrity of your sculpture:

✅ Recommended Placement:
* Area with alternating shade and sun (avoid permanent full sun exposure)
* Well-ventilated space
* Covered terrace, pergola, veranda, shaded garden
* Indoor (living room, hallway, office)

⚠️ EXPOSURE TO NATURAL ELEMENTS:
Prolonged and repeated exposure to extreme weather conditions may cause natural wear to the structure:
* Continuous intense sunlight → possible micro-cracks, surface crazing
* Repeated freeze/thaw cycles → micro-cracks, resin cracking
* Extended harsh weather (rain, snow, hail) → possible blistering, surface deterioration
* Significant temperature fluctuations → resin expansion/contraction, crazing

These phenomena are normal for outdoor-exposed sculptures, just like premium garden furniture or outdoor artworks.

RECOMMENDED MAINTENANCE:
* Regular cleaning with clear water and mild soap
* Drying with soft cloth
* For prolonged outdoor exposure: cleaning every 3-6 months
* Optional application of protective wax (not included) to extend protection

7.5 WARRANTY EXCLUSIONS

The warranty DOES NOT COVER:
* Natural structural degradation due to exposure to elements (sun, rain, frost, wind)
* Normal aging of outdoor-exposed sculptures
* Micro-cracks, crazing, blistering, or cracking resulting from prolonged exposure to weather conditions
* Damage resulting from lack of maintenance, abnormal use, or negligence
* Damage caused by improper unpacking (box cutter, sharp objects)
* Impacts, drops, or mechanical damage
* Natural artisanal variations (finishes, color nuances) inherent to the manufacturing process

These phenomena do not constitute a manufacturing defect but normal wear for a product exposed to natural elements.

7.6 CUSTOMER ACKNOWLEDGMENT AND ACCEPTANCE

IMPORTANT: By purchasing this sculpture, the Customer acknowledges and accepts that:
* An outdoor-exposed artwork undergoes natural structural aging
* Micro-cracks or crazing may appear over time depending on exposure conditions
* Optimal usage conditions (partial shade, ventilated, regular maintenance) significantly extend lifespan
* No claim can be made for structural degradation related to normal exposure to elements

COMPARISON: Like designer garden furniture, bronze garden sculptures, or outdoor installations, our sculptures are designed for exterior use but require precautions and maintenance to preserve their structural integrity as long as possible.

7.7 Claims
Any claim must be submitted within 48 hours of delivery to contact@monumenta.art with dated photos and detailed description of the issue.

MONUMENTA reserves the right to examine the product or request additional information before acknowledging non-conformity.

7.8 Liability Limitations
For deliveries to European islands and overseas territories, MONUMENTA's liability ends upon delivery of the sculpture to the continental freight forwarder. The Customer is responsible for organizing and paying for final maritime transport, as well as any damage occurring after departure from the freight forwarder.

MONUMENTA cannot be held responsible for indirect damages such as loss of profit, loss of clientele, loss of data, or any other indirect commercial or financial loss.

8. PERSONAL DATA

Your personal data is collected and processed in accordance with the General Data Protection Regulation (GDPR) and French Data Protection Act.

Information collected during ordering (name, first name, address, email, phone) is necessary for order processing and delivery. It is kept for the duration necessary to execute the contract and legal obligations.

9. INTELLECTUAL PROPERTY

All content on the monumenta.art website (images, texts, logos, designs) is the exclusive property of MONUMENTA and protected by intellectual property laws.

Any reproduction, representation, modification, publication, or adaptation of all or part of the Site's elements, regardless of the means or process used, is prohibited without prior written authorization from MONUMENTA.

Purchase of a MONUMENTA sculpture confers ownership of the physical object only. No intellectual property rights to the design, models, or creations are transferred. The Customer may not reproduce, copy, sell, or commercially exploit the sculpture's design.

10. MEDIATION AND DISPUTE RESOLUTION

10.1 Consumer Mediation
In accordance with Articles L611-1 and following of the French Consumer Code, consumer Customers have the right to use a consumer mediator free of charge for amicable resolution of a dispute with MONUMENTA.

The Customer may also use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr/

10.2 Applicable Law and Jurisdiction
These Terms of Service are governed by French law.

In case of dispute, and after failure of any attempted amicable resolution, French courts shall have exclusive jurisdiction. For disputes concerning consumers, courts of the place where the defendant resides or the place of actual delivery shall have jurisdiction.

11. ACCEPTANCE OF TERMS OF SERVICE

Validation of the order by the Customer constitutes full and complete acceptance of these Terms of Service. The Customer acknowledges having read all conditions and declares to accept them without reservation.

The Customer acknowledges having been informed of:
- The artisanal and unique nature of each sculpture
- Natural variations inherent to the manufacturing process
- The use of 3D renders and digitally generated visuals for illustrative purposes
- Exclusion of right of withdrawal for personalized goods
- Recommended conditions of use and maintenance
- Natural aging in case of prolonged outdoor exposure
- Warranty exclusions
